Yes it's the public version so no you don't need to preorder to play this.
I dled it in about an hour from fileshack only to have a dll missing when I finally clicked the exe to run it. Least it wasn't a all nighter download or I would have been a little bit more steamed.

AOL is giving me 2x as fast dl rates this time around at 750kb/sec so give that one a try.
